By accessing services provided by PicJar whether as a guest or a registered member, you agree to be bound by, and comply to the Terms and Conditions stated here as well as any other rules displayed elsewhere and linked to from the homepage of the PicJar web site.
When using PicJar you should consider that visitors to the site may be of any age and as such public content on the site whether textual or in image form must be suitable for viewing by young and old alike. This policy has been created to reflect that.
Illegal Use
The PicJar system may only be used for lawful purposes. Illegal use includes but is not limited to:
Illegal content, whether protected by passwords or not, will usually mean instant account termination and depending on the actual content appropriate authorities may be informed. In order to protect ourselves and our visitors, content bordering in the legal/illegal 'grey area' may be treated the same way as illegal content.
Adult Content
Adult Content may not be made available for public viewing on PicJar under any circumstances, legal adult content must be protected using the Album permissions feature and a suitable note warning visitors to the content must be displayed in the folder or album description. Illegal content is not welcome, please see Illegal Use.
General Conduct
You must not use any PicJar services with the specific aim to cause problems for staff or members, including but not limited to, overloading the servers.
You may optionally register as a PicJar member in order to upload your own photos and post comments to message boards, we will require some personal, and accurate, information about you during the registration process. For more details please see our Privacy Policy.
All images uploaded to PicJar must either have no form of copyright attached to them, or in the case of copyrighted material you must have the legal rights to make the photos available from the PicJar system. You must ensure that any copyright or trademark is clearly stated along side images. Neither PicJar or parent company GoldNode Communications claim any rights to images uploaded to the system.
Our terms and conditions do not allow making adult content available for public viewing and our first step in discovering or being informed of a breach of this nature will be to remove the content. Unfortunately we cannot guarantee that all the public content on this site is free from adult material at any one time. If you have authorized a minor to use PicJar we suggest that this usage is under your constant supervision. Whether under your constant supervision or not, you will be responsible for any misuse by the minor.
We will do our best to keep the PicJar system running at all times. Downtime can happen for a number of reasons beyond our control and we do not produce an up-time guarantee for that reason. It is in our interest to keep any downtime to a minimum in order to keep members and to provide a service that members are happy to pay for. Paying PicJar members will always be given priority over free account users when it is necessary to prioritise support or services. Under no circumstances will we be liable for any failure of the PicJar services for reasons beyond our control.
Backups and Loss of Data
Although we take regular backups of PicJar system files, we may not take regular backups of your images. Loss of your images can happen for a number of reasons and we take no responsibility for this. If you share your photos via PicJar you should never use the service as the master storage for your photos. You must always keep local copies otherwise your photos may become irretrievable due to hardware or software problems. We have no immediate plans to keep regular backups of photos stored on the PicJar servers as to do so would increase our operating costs and so increase the costs we pass on to paying members.
Standard User Account (Free)
As a Standard User we will provide you with 100MB of storage for your photos and messages. Your account may be terminated at any time by either yourself or the PicJar operators for any reason. Although we reserve the right to terminate you account instantly, at any time, an instant termination will normally only happen if you are in breach of the terms stated in this document. This is an advertisement funded account. In order to provide the space for no charge we may sell advertising space on your pages.
A single household is only entitled to one free Standard User Account. Multiple accounts of this type registered to a single person may be removed without warning.

Gold Account (Not currently available)
As a Gold User we will provide you with 800MB of storage for your photos and messages. You will be required to pay $12.00 at the beginning of each twelve month period that you wish to hold your Gold Membership. Providing this single payment option keeps both operating costs, and your own fees down so we do not accept part payments. If you wish to terminate your account you can switch off the auto-renew option on the web page at least thirty days before your next payment is due, once the current payment period runs out, you account will then be automatically downgraded to a Standard account if you are using less than 100MB of storage, or it will be closed if you are using more than this. If you wish to completely close your account in the middle of a payment period we will not offer any refund for unused months. Any breach of the Terms and Conditions will normally result in instant termination with no refund.

Gold Account Beta Tester (Free for limited time)
While we are testing PicJar ready for the official launch in 2006, we are not accepting any fees for using the service as we may still need to take the site down regularly to perform updates (although we still aim to keep this to a minimum and inform you of such downtime via the forums in advance). We do however invite members to apply to upgrade their account (via the control panel) to this Gold Account Beta Tester member status in order to help us test the PicJar services and provide the storage space of a paying Gold Account user without charge.
Once PicJar is officially released (date to be announced in 2006) you will get an additional three months free usage of your Gold Account, during which time you can either bring your disk usage down to 100MB and downgrade back to a Standard Account or you can pay $12.00 a year to keep your Gold Account.
Should your disk usage remain above 100MB after the testing has been completed, and after your additional three months of free Gold Account access, but you decide not to pay for the ongoing Gold Account usage, your account will simply be closed and you will owe nothing.
You may downgrade your account from a Gold Account Beta Tester at any time during the testing phase and the additional three months using the account control panel.
As there is no charge made for this account your account may be terminated at any time by either yourself or the PicJar operators for any reason. Although we reserve the right to terminate you account instantly, at any time, an instant termination will normally only happen if you are in breach of the terms stated in this document.
As a Gold Account Beta Tester you web pages may contain advertisements, these will be removed after launch.
